1. Acceptance of Terms

By engaging The Shamanic Goddess ("the Company") for services, you agree to be bound by these terms and conditions.

2. Scope of Services

The Company will provide Consultations, Guidance, Coaching, Wellness Recommendations and Suggestions, Retreat and Speaking Engagement Services ("services") as outlined in the mutually agreed-upon service contract. Any changes to the scope of services must be agreed upon in writing by both parties.

3. Fees and Payment

Clients agree to pay the fees specified on the booking page provided or the agreed-upon fees for the Speaking Engagement contract with the Company. Payment terms, including due dates and accepted payment methods, will be outlined in the invoice. All payments for services are due in full at the time of booking services unless otherwise specified. Full deposit payments are due at the time of booking services with deposit required unless otherwise specified. The remainder of the payment for service will be due upon the agreed-upon date.

4. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary and confidential information disclosed during the consulting engagement. The Company will not disclose client-specific information without prior written consent.

5. Intellectual Property

All intellectual property created by the company, unless otherwise specified in writing, is the property of the company. The Company retains the right to use anonymized and aggregate data to improve its services.

All content included as part of our Service, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of The Shamanic Goddess, LLC or its suppliers and protected by copyright and other laws that protect intellectual property and proprietary rights. You agree to observe and abide by all copyright and other proprietary notices, legends, or other restrictions contained in any such content and will make any changes thereto.

You are prohibited from modifying, publishing, transmitting, reverse engineering, participating in the transfer or sale, creating derivative works, or in any way exploiting any of the content, in whole or in part, found on the Site. The Shamanic Goddess, LLC content is not for resale. Your use of the Site does not entitle you to make any unauthorized use of any protected content, and in particular, you will not delete or alter any proprietary rights or attribution notices in any content. The Shamanic Goddess, LLC does not grant you any licenses, express or implied to the intellectual property of The Shamanic Goddess, LLC or our licensors except as expressly authorized by the Terms.

International Users

The Services are controlled, operated, and administered by The Shamanic Goddess, LLC from our offices in the USA. If you access the Services from a location outside the USA, you are responsible for compliance with all local laws. You agree that you will not use The Shamanic Goddess, LLC content accessed through The Shamanic Goddess, LLC in any country or any manner prohibited by any applicable laws, restrictions, or regulations.

6. Client Responsibilities

Clients agree to provide the necessary information, materials, and access required for the successful delivery of services. Delays or issues resulting from the client's failure to meet these responsibilities may impact program timelines and outcomes.

Any services unable to be accurately completed due to misrepresentation, misinformation, or lack of disclosure, is the sole responsibility of the client. Client agrees to indemnify, defend, and hold harmless The Shamanic Goddess, LLC, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney’s fees) relating to or arising out of incidents that occur due to client's misconduct, misuse, or misrepresentation while receiving services from The Company.

7. Termination of Services

Either party may terminate the service agreement with written notice if the other party breaches these terms. Fees for services rendered up to the termination date will be due upon termination.

8. Limitation of Liability

The Company's liability for any claim arising from the services is limited to the fees paid for those services. The Company is not liable for any consequential, incidental, or indirect damages.

Client agrees to waive and indemnify The Shamanic Goddess, LLC and its officers, directors, employees, agents, and third parties from any liability and responsibility for any damages, or harm resulting from any misconduct, misuse, or misrepresentation of the client.

9. Governing Law

These terms and conditions are governed by the laws of the State of North Carolina. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in the State of North Carolina.

Arbitration

In the event the parties are not able to resolve any dispute between them arising out of or concerning these Terms of Conditions, or any provisions hereof, whether in contract, tort, or otherwise at law or in equity for damages or any other relief, then such dispute shall be resolved only by final and binding arbitration under the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association, or similar arbitration service selected by the parties, in a location mutually agreed upon by the parties. The arbitrator’s award shall be final, and judgment may be entered upon it in any court having jurisdiction. If any legal or equitable action, proceeding or arbitration arises out of or concerns these Terms and Conditions, the prevailing party shall be entitled to recover its cost and reasonable attorney’s fees. The parties agree to arbitrate all disputes and claims regarding these Terms and Conditions or any dispute arising as a result of these Terms and Conditions.

10. Amendments

The Shamanic Goddess, LLC reserves the right, in its sole discretion, to change the Terms under which The Shamanic Goddess, LLC is offered. Continued engagement with the Company following the amendment constitutes acceptance of the revised terms. The most current version of the Terms will supersede all previous versions. The Shamanic Goddess, LLC encourages you to periodically review the Terms to stay informed of our updates.

Cancellations & Refund Policy

1. Scope

This refund policy applies to services provided by The Shamanic Goddess.

2. Refund Eligibility

Refunds are only available under the following circumstances:

Failure to Deliver Services: If The Shamanic Goddess fails to deliver the agreed-upon services, a full refund will be issued.

3. Refund Process

To request a refund, the client must contact The Shamanic Goddess in writing via email within the specified timeframe. The request must include details of the failure to deliver services.

Upon receiving a valid refund request, The Shamanic Goddess will review the circumstances and, if deemed appropriate, process the refund within 14-21 days from the date of the request.

4. Non-Refundable Circumstances

Refunds will not be issued under the following circumstances:

Change of Mind: Refunds will not be granted due to a change of mind or circumstances on the part of the client after services have been delivered.
Client's Actions: If the client's actions or decisions contribute to the dissatisfaction or failure to deliver services, a refund may be denied.

5. Payment Method

Refunds will be issued using the same payment method used for the original transaction. If this is not possible, an alternative method will be agreed upon between The Shamanic Goddess and the client.

6. Amendment of Cancellation and Refund Policy

The Shamanic Goddess reserves the right to amend this policy at its discretion. Any changes will be communicated to clients in advance.

7. Rescheduling and Cancellations Policy. The Shamanic Goddess requests that all Clients who are unable to keep appointments please give 36-hour notice of canceling and rescheduling of appointments to accommodate the schedule. Failure to give 36-hour notice will result in a $75 cancellation fee. After 2 failed or missed appointments, the Client may have to wait longer for an appointment. If the client reschedules and misses an appointment again, the company reserves the right to refuse to schedule the client for future appointments.
